Terms of Service

These Terms govern your access to PassFlag and set the ground rules for using guided Decks and inspection records.

Effective August 30, 2026

1. Agreement to these Terms

By accessing or using PassFlag websites, applications, or services (the “Service”), you agree to these Terms. If you use the Service for an organization, you represent that you are authorized to accept these Terms on its behalf. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old and legally able to enter a binding agreement. Workplace users must also be authorized by their employer or organization to use the Service and the information made available through it.

3. Accounts and organizations

You are responsible for accurate account information, safeguarding your credentials, and activity under your account. Notify us promptly if you believe your account has been compromised. Organization administrators control memberships, roles, Deck assignments, equipment records, and access to their workspace. Your use may also be subject to your organization’s policies and separate agreement with PassFlag.

4. The Service

PassFlag provides tools to create guided Decks, perform repeatable checks, record outcomes, flag concerns, and review or export records. Features may vary by account type, role, organization configuration, device, or release stage.

Important operational notice

5. PassFlag does not replace safety judgment

PassFlag is a workflow and recordkeeping tool. It does not replace training, supervision, manufacturer instructions, maintenance requirements, professional judgment, or applicable safety laws and procedures. You and your organization are responsible for the accuracy and suitability of every Deck, for responding to flagged conditions, and for deciding whether equipment or work may safely proceed. Stop work and follow your established escalation procedures whenever a condition may present a risk.

6. Your content

You retain ownership of Decks, notes, equipment information, inspection content, and other material you submit (“Your Content”). You grant PassFlag a worldwide, non-exclusive license to host, copy, process, display, transmit, and back up Your Content only as needed to provide, secure, support, and improve the Service and comply with law.

You are responsible for having the rights and permissions needed to submit Your Content. Public Decks may be discovered and used by others; unlisted Decks may be accessed by anyone with the link. Do not publish confidential, regulated, or personal information unless you are authorized to do so.

7. Acceptable use

You may not use the Service to:

  • Violate law, another person’s rights, or workplace authorization.
  • Upload malicious code or interfere with the Service or another user.
  • Probe, bypass, or defeat access controls or security protections.
  • Misrepresent identity, inspection results, authorization, or record integrity.
  • Use automated means to scrape or overload the Service without written permission.
  • Reverse engineer the Service except where applicable law expressly permits it.

8. Privacy and third-party services

Our Privacy Policy explains how we handle personal information. The Service relies on third-party infrastructure, including authentication, hosting, and database providers. Those services may be governed by their own terms and notices.

9. Service changes and availability

We may add, change, suspend, or discontinue features. We aim to provide a reliable Service, but availability is not guaranteed. You are responsible for maintaining any exports, backups, or alternative procedures your operations reasonably require, including during outages or emergencies.

10. Suspension and termination

You may stop using the Service at any time. We may restrict or terminate access if you materially violate these Terms, create security or legal risk, fail to pay amounts due under a separate agreement, or if continued operation is no longer commercially reasonable. Where practical, we will provide notice and an opportunity to export data consistent with your organization’s rights and applicable law.

11. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available.” PassFlag disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade. We do not warrant that the Service or any Deck will be uninterrupted, error-free, complete, or suitable for a particular regulatory or operational requirement.

12. Limitation of liability

To the maximum extent permitted by law, PassFlag will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business interruption. PassFlag’s total liability arising from the Service will not exceed the amount paid for the Service during the 12 months before the event giving rise to the claim, or US$100 if no amount was paid. These limits do not apply where they are prohibited by law.

13. Additional organization terms

An order form, data processing agreement, or other written agreement may apply to an organization’s use of PassFlag. If that agreement conflicts with these Terms, the signed agreement controls for that organization. Otherwise, these Terms and applicable law govern.

14. Changes and contact

We may update these Terms. Material changes will apply prospectively after reasonable notice when required. Questions about these Terms can be sent to info@passflag.com.
